Parfumdevoyage-vtc.fr is a chauffeur-driven motorized vehicle transportation services platform, operating exclusively on a reservation basis, published and operated by the company Parfum de Voyage, whose head office is located at 1 rue d’Auvergne, Versailles (78000), and registered under the Intracommunity VAT number FR22982548570 (hereinafter “Parfum de Voyage”).
The aim of this platform is to offer its private customers a booking solution for one-off trips or trips over a defined time period, including one or more transport services by motorized land vehicle, provided by drivers who are members of its network, natural or legal persons, working as chauffeur de voitures de tourisme (VTC) and/or transport de personnes avec chauffeur, in accordance with current French legislation. Article 1.
Acceptance of the General Conditions of Use
Use of the Site is subject to full acceptance of these General Terms of Use (GTU).
When creating their user account, users must tick the box “I accept the General Terms of Use of the site and the service offered”.
Only full acceptance of the GCU will enable users to access the services offered by the Site.
These GCU can only be accepted in their entirety, without the possibility of partial application or reservations on the part of users. Article 2.
Modification of the General Conditions of Use
Parfum de Voyage reserves the right to modify the General Conditions of Use (GCU) as well as the functionalities of the Site at any time.
These modifications come into force as soon as they are published on the Site, and each user acknowledges that he/she has read the GCU before using the Site.
No modification will apply to a transaction in progress if it occurs after the user has paid for an order.
Parfum de Voyage also reserves the right to introduce new services, free or paying, on the Site. Article 3.
Creating a User Account
To make a reservation on the www.parfumdevoyage-vtc.fr website (hereinafter referred to as the “Site”), each user must create a user account.
When registering, the user chooses a personal and confidential login and password, non-transferable to third parties.
Parfum de Voyage reserves the right to modify, change or delete a login and/or password at any time, after notifying the user, in order to ensure the proper functioning of the service.
The user must register personal information such as name, first name, e-mail address, telephone number and postal code of residence, as well as at least one means of payment.
Parfum de Voyage does not record or retain the user’s banking information at any time. Article 4.
Reservation

4.1.
Conditions Préalables
Booking a trip via the Application or the Site is subject to the User’s prior acceptance of these General Terms and Conditions. 4.2.
Processus de Réservation

4.2.1.
Identification
To make a reservation, the User logs on to the Application or Site using his/her login and password. 4.2.2.
Réservation Anticipée
For an early booking, the User indicates the desired date, with day, month and time, within a period of between 2 hours and 180 days following the order date. 4.2.3.
Informations Requises pour la Course
The User fills in the details of the trip: place of departure, destination if applicable, type of vehicle required, means of payment, and the passenger’s contact details if different from the User.
Without this information, the order cannot be finalized.
If several means of payment are registered, the User selects one to proceed with the order. 4.3.
Tarification de la Course
Parfum de Voyage offers a rate for the requested trip.
The User may accept or refuse this offer.
In the case of acceptance, the User verifies that all information displayed is correct.
Parfum de Voyage then transmits the details of the order to the carrier.
The price of the journey does not include additional charges such as tolls or paid parking, which are the responsibility of the customer. 4.4.
Retard / Annulation de la Commande
To validate an order, the User must accept these GCU, which take precedence over the carrier’s general conditions of use in the event of delay or cancellation of the order, even if they are more favourable to the User. 4.4.1.
Retards
If the carrier waits more than 15 minutes after the agreed time, it may cancel the journey and the User will automatically be billed.
A 20-minute waiting allowance applies to journeys from a station or airport, upon presentation of train or flight references.
Beyond this time, the carrier may charge a surcharge for each minute of delay, capped at €20 per hour of delay. 4.4.2.
Annulation
The User may cancel the trip free of charge up to two (2) hours before the scheduled pick-up time.
Between two (2) hours and the scheduled time, a fee equivalent to 50% of the fare will be charged.
After the scheduled time, a fee of 100% will be charged.
In the event of a dispute, Parfum de Voyage will be automatically informed and will endeavour to resolve it amicably, without any contractual obligation other than that of providing reasonable efforts. 4.5.
Engagements de Parfum de Voyage
Following the User’s request, Parfum de Voyage confirms the order by email or SMS, including the name of the transporter, the price of the journey and the category of vehicle (Eco, Sedan, Van or Motorbike cab).
Arrival estimates provided by Parfum de Voyage are indicative and based on standard times, and do not engage its responsibility. Article 5.
Methods of payment
No payment is made directly to the carrier.
Payments must be made to Parfum de Voyage, who will collect them once the journey has been accepted by the carrier.
In the event of delay by the carrier resulting in the cancellation of the trip according to its own general conditions of sale and/or cancellation referred to in Article 4.3, Parfum de Voyage will reimburse the client. Article 6.
Race performance

6.1 Course of the trip The trip starts when the passenger boards the carrier’s vehicle and ends as soon as the passenger leaves the vehicle. 6.2 Taking charge of the Passenger The carrier may refuse to take charge of the passenger in the following situations:

  • Passenger’s obvious state of intoxication ;
  • Unsafe passenger behavior ;
  • Exceeding the number of people authorized at the time of reservation ;
  • Luggage in excess of specifications or volume exceeding vehicle capacity ;
  • Inappropriate or immoral behavior.

In such cases, the user will be billed for the journey despite the refusal to pick up the vehicle.
The carrier may also cancel the pick-up in the event of force majeure, as defined by current legislation and recognized by jurisprudence.
The user will be notified by email and no invoicing will be applied in this context. Article 6.3 Modification of the Order by the Passenger Once the reservation has been made, it is impossible to modify the trip, as we specifically reserve our driver’s time slot for your pick-up.
Therefore, any need for modification, whether for the time or any other information of your reservation, requires the cancellation of the existing reservation and the creation of a new order with the correct information. Article 6.4 Route of the trip The price of the trip being fixed in advance, the carrier is free to choose the route it deems shortest or quickest to take the user to his destination.
Although the user may suggest a route, the final decision rests with the transporter.
Similarly, any intermediate stops or detours requested by the user remain at the discretion of the carrier. Article 7.
Guarantees and Responsibility of Parfum de Voyage

7.1 Access to the Platform Access to our Platform is provided on an “as is” and “as available” basis. 7.2 Risks associated with the use of the Internet The Customer acknowledges the risks associated with the use of the Internet and networks, including the possibility that personal information may be captured or transferred to countries that do not guarantee adequate data protection.
Parfum de Voyage declines all responsibility for damages resulting from the transmission of information, including identifiers and passwords via our Platform.
7.3 No warranties We make no express or implied warranties as to the quality of our Platform, its compatibility with specific needs, or compliance by the Customer and Users with the rules of use of our service.
7.4 Third-party information Parfum de Voyage does not guarantee the accuracy or relevance of information published on our Platform by third parties.
7.5 Responsibility for third party rights We accept no responsibility for any claims or actions by third parties claiming rights, in particular private rights, to any content not created by Parfum de Voyage.
7.6 Interruptions and continuity of the Platform We cannot guarantee uninterrupted and continuous operation of our Platform in the event of force majeure or unforeseeable events as defined by law.
This includes, but is not limited to, exceptional weather conditions, natural disasters, and any legal or regulatory obligation imposed by the relevant authorities that could substantially modify our services. 7.7 Commitment to our users We undertake to check the availability of the services offered and to make every effort to provide an available driver as quickly as possible.
Our commitment is based on reasonable means.
Parfum de Voyage cannot be held responsible if the search for an available chauffeur is unsuccessful, even for an advance booking. 7.8 Limitation of liability In the event that Parfum de Voyage is held liable for failure to comply with our obligations under these general terms and conditions, our liability is limited to direct, personal and specific damages.
We expressly exclude all liability for indirect or immaterial damages such as financial, commercial, operating, data or chance losses.
In no case shall the damages awarded to the Customer exceed the total amount paid by the Customer for the order during which the damage occurred. Article 8.
Responsibility of the User
The User is required to behave in a civil and reasonable manner throughout the Race, without hindering its proper execution. These obligations also apply to the Passenger if the latter is different from the User, the User guaranteeing compliance with these conditions for the Passenger. Article 9. Divisibility If any provision of these TOU is declared invalid or unenforceable by any competent authority, such provision shall be deemed unwritten, without affecting the validity of the remaining provisions which shall remain in full force and effect. Article 10. Applicable law – Jurisdiction These GCU are governed by French law, and any dispute concerning their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of the Versailles Court of Appeal.
